Rent Stab No More? Defending Against Substantial Rehabilitation and Demolition Claims

In the post-HSTPA landscape, landlords may remove buildings from rent stabilization in very limited circumstances, and substantial rehabilitation and demolition are two of the remaining ways for landlords to deregulate an entire building from rent stabilization.

 

Generally, the law of substantial rehabilitation requires that at least 75% of building-wide and individual housing accommodation systems must have been replaced; and that the rehabilitation must have been commenced in a building that was in a substandard or seriously deteriorated condition.

 

In this training, we will review the legal standards for substantial rehabilitation and demolition under the Rent Stabilization Code, practice issue-spotting, and learn how to defend tenants against these claims in various forums.
