Domestic Violence and Consumer Debt Defense

Legal Services New York's Justice Learning Center and Feerick Center for Social Justice’s CLARO program are proud to present a collaborative training between Legal Aid and CAMBA Legal Services on consumer debt issues resulting from coerced debt and financial abuse faced by survivors of domestic violence.

 

This one-hour training will provide an overview of the intersection between domestic violence law practice and consumer debt defense. Instructors will provide tools for survivors and their advocates to issue-spot and address common problems and issues in these cases. Attendees will also learn important considerations in working with survivors, who often experience trauma from physical, psychological, and financial abuse.

About the Faculty

    Divya Subrahmanyam (Speaker)

    Divya (she, her) is a senior staff attorney in the consumer law unit at CAMBA Legal Services, Inc., in Brooklyn, New York, which assists low-income New Yorkers dealing with a wide range of consumer matters, including debt collection, rent arrears suits, auto fraud, identity theft and credit report disputes. In addition to providing individual representation, Divya pursues appeals in state court and brings affirmative litigation in state and federal court to enforce the rights of consumers under EFTA, the FDCPA, New York’s consumer protection statutes, and more. Divya is the former co-chair of the Domestic Violence and Consumer Law Working Group in New York City, and co-authored a 2018 policy report entitled Denied: How Economic Abuse Perpetuates Homelessness for Domestic Violence Survivors. She previously worked litigating class actions against states on behalf of children and youth, and before that served as a law clerk: first to the Honorable Vernon S. Broderick of the U.S. District Court for the Southern District of New York, and then to the Honorable Jane B. Stranch of the U.S. Court of Appeals for the Sixth Circuit. She earned her B.A. from Yale University and her J.D. from Harvard Law School.

    Claire Mooney (Speaker)

    Claire Mooney (she, her) is the DV-Consumer Staff Attorney at the Legal Aid Society where she represents low-income survivors of domestic violence in consumer legal matters. She is currently a co-chair of the New York City Domestic Violence and Consumer Law Working Group. Previously, Claire served as a pro bono scholar for Sanctuary for Families assisting survivors of gender-based violence with advocating for their rights under consumer law. Claire earned her J.D. from Cardozo Law School.

    Johanna Ocana (Moderator)

    Johanna Ocana (she, her, hers) is the Senior Coordinating Attorney of Pro Bono Initiatives at the Feerick Center, where she coordinates limited scope legal services clinics for unrepresented New Yorkers facing debt collection through the courts or CLARO clinics. Johanna comes to the Feerick Center from Bronx Legal Services, where she represented tenants and tenant associations organizing to better their living conditions and enforce their tenant and Fair Housing rights. Johanna received her Bachelor of Arts in Political Science from Columbia University and her law degree from CUNY School of Law.
