Negotiating Modifications and Settlement Agreements in the Foreclosure Context

This session will address a range of issues that arise when negotiating and drafting foreclosure and mortgage-related settlement and loan modification agreements. Topics include: over-reaching confidentiality and non-disparagement clauses; non-mutual releases; attorney’s fees, costs accruing after settlement; and ethical issues arising throughout the process.

    Shabnam Faruki (Speaker)

    Shabnam Faruki joined Legal Services NYC in 2009 and is currently the temporary director of the Foreclosure Prevention Project in the Brooklyn office. Prior to joining SILS, she was an attorney at the Legal Assistance Foundation of Metropolitan Chicago. Shabnam received her B.A. from Yale University, a Masters in International Relations from the London School of Economics, and her J.D. from New York University, where she was an Arthur Garfield Hays Civil Liberties Fellow.

    Dianne Woodburn (Speaker)

    Dianne O. Woodburn is the Legal Services Supervisor for the Senior Initiative and Home Retention Programs assisting seniors who victims of scams or are at risk of foreclosure. Ms. Woodburn is also the Supervising attorney for Queens Legal/Social Work Elder Abuse Prevention Project (LEAP). LEAP is an elder abuse prevention project that combines teams of social workers and attorneys to help senior citizens fight against physical and financial abuse and exploitation in Brooklyn, Manhattan and Queens. Prior to joining Legal Services in 2003, Ms. Woodburn was employed at the trial litigation firm of Quinn Emanuel Urquhart Oliver & Hedges. Ms. Woodburn is also an Adjunct Professor at St. John?s University School of Law. Ms. Woodburn graduated from New York University and St. John?s University School of Law.
