DVD - Best Practices for Working with Clients with Decision Making Capacity Challenges

This training will focus on a lawyer’s responsibilities and best practices for assessing and working with a client who may have diminished mental capacity. We will cover the process of assessing capacity, the relevant NY Rules of Professional Conduct, guardianships under Article 81 of the N.Y. Mental Hygiene Law (including the rights of the person alleged to need a guardian and the legal standard and process for appointing a guardian under Article 81 of the Mental Hygiene Law), the relationship between Article 81 and CPLR 1201, and emerging notions of capacity under the U.N. Convention on the Rights of People with Disabilities.

About the Faculty

    Joe Rosenberg (Speaker)

    Joe is the Associate Dean of Clinical Programs and Professor at CUNY Law School. Joe has taught in the Elder Law Clinic and is currently teaching in the Community & Economic Development Clinic, developing a housing project with Queens Legal Services. Joe was a member of CUNY Law School's inaugural class in 1986. After graduation, he worked as a staff attorney for the Legal Aid Society of Northeastern New York, specializing in government benefits, health law, and family law. He is co-author of the practice treatise New York Elder Law.
